A tomato is a fruit. It develops from the ovary of a flowering plant after fertilization, and it contains seeds. This is the scientific definition of a fruit.

But we use it as a vegetable in cooking and in the preparation of salads

Fruits and vegetables comprise different parts of a plant. When we broadly look into the matter, we realize that fruits are the matured flowers or grow from the flowering part of a plant containing seeds. On the other hand, vegetables are all other edible parts of a plant like leaves, stems, root,s etc. In the case of a tomato, we know that it comes from a flower and has seeds, so it is a fruit. A tomato is a fruit because botanically a fruit will at least have one seed and will grow from the flower part of the plant.
